Terms and Conditions for CeramVibe

Welcome to CeramVibe, your digital platform for ceramic art and craftsmanship. These Terms and Conditions ("Terms") govern your access to and use of CeramVibe's mobile-optimized marketplace, website, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein. If you do not agree with any part of these Terms, you must not use our Service.

1. Acceptance of Terms

By creating an account, accessing, browsing, or using the CeramVibe Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as they may be updated from time to time. CeramVibe reserves the right to modify these Terms at any time without prior notice. Your continued use of the Service after any such modifications constitutes your acceptance of the new Terms. 3. Use of the Service

• Permitted Use: Our Service is intended for personal and commercial activities related to ceramic art, including browsing, buying, and selling ceramic products, and interacting within our community.
• Prohibited Conduct: You agree not to use the Service for any unlawful purpose or in any way that might harm, defame, or otherwise impair the experience of other users. Prohibited activities include, but are not limited to:
  • Posting false, inaccurate, misleading, or defamatory content.
  • Infringing on any third party's rights, including copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right.
  • Distributing viruses or any other technologies that may harm CeramVibe or the interests or property of CeramVibe users.
  • Harvesting or otherwise collecting information about users, including email addresses, without their explicit consent.

4. Content and Intellectual Property

• User-Generated Content: You retain all ownership rights in the content you submit to CeramVibe. By posting content, you grant CeramVibe a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with the Service and CeramVibe's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels.
• CeramVibe's Intellectual Property: All content available on CeramVibe (excluding user-generated content), including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, and software, is the property of CeramVibe or its content suppliers and protected by international copyright and intellectual property laws.

5. Purchases and Transactions

• Seller Responsibilities: Sellers on CeramVibe are responsible for providing accurate descriptions of their products, fulfilling orders promptly, and handling customer service issues related to their listings.
• Buyer Responsibilities: Buyers are responsible for reviewing product descriptions, prices, shipping information, and return policies before making a purchase.
• CeramVibe's Role: CeramVibe acts as a marketplace to connect buyers and sellers. We are not directly involved in the transaction between buyers and sellers, and we do not guarantee the quality, safety, or legality of items listed, the truth or accuracy of listings, or the ability of sellers to sell items or buyers to pay for items.

6. Disclaimers and Limitation of Liability

• Service "As Is": The CeramVibe Service is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied.
• Limitation of Liability: To the fullest extent permitted by applicable law, CeramVibe, its affiliates, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

7. Indemnification

You agree to defend, indemnify, and hold harmless CeramVibe and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service.
